Do I need a tourist licence to list my property on Airbnb?
Yes, in Andalucia and the Comunidad Valenciana. Both regions' schemes require the registration number to appear on every advertisement of the property, and an online listing counts as advertising under each region's own rules. Check the platform's current listing rules before you publish.
How long does it take to get a tourist licence?
Timing differs by region. Andalucia's registration starts when the declaracion responsable is filed, so the property can be advertised from that point. The Comunidad Valenciana's registration becomes advertisable only once the Registro de Turismo de la Comunitat Valenciana has processed the filing, and submitting it is not enough on its own. The occupation-licence and community-of-owners paperwork behind either filing can also take longer to assemble. Do foreigners need anything extra to apply for a tourist license?
Use the ownership and identification documents required by the regional process, covered in the documents section above. Confirm with the regional authority or your advisor whether nationality or residence status changes the paperwork for your application.
Can my community of owners stop me getting a licence?
A community of owners cannot stop the regional registration itself, but it can vote, by a three-fifths majority under Ley de Propiedad Horizontal article 17.12, to prohibit the actual letting activity inside the building. That vote makes a licence unusable in practice even where the region has granted it.
What happens if I already let my property without a licence?
Do not assume a new declaracion responsable cures an earlier unlicensed period. Andalucia classifies unlicensed letting as clandestine activity, a grave infringement carrying a fine of €2,001 to €18,000 under Ley 13/2011, and the Comunidad Valenciana classifies an unregistered listing as a serious infringement. Check the region-specific remedial route and any past exposure before filing or advertising again.
